Powers of Attorney and Elderly Client

We recommend a POA to ensure that if you are unwilling or become incapable of acting in your own affairs, both welfare and financial, then a member of your family, friend or a professional would take on that appointment to deal with your affairs on an ongoing basis.

If no POA is in place at the time of incapacity the courts can appoint a guardian to manage your affairs. This will be time consuming, costly and frustrating for your family and friends and can be avoided by simply granting a POA when you are deemed capable.

Smail and Ewart will prepare a POA on your instructions, obtain the necessary certificates and register it with the Public Guardian, giving you complete piece of mind.

Guardianship Orders

Where Power of Attorney is unable to be achieved through incapacity Smail & Ewart will take the family through the process and assit with the appointment of Guardian (financial and welfare) and the management of the Guardianship following the Guardians appointment.
